Membership Terms, Prediction Game Rules & Prize Conditions

IMPORTANT: READ THESE RULES CAREFULLY BEFORE PARTICIPATING

By becoming a Member or participating in the Prediction Game, you agree to be bound by these Official Rules, all applicable laws, and the decisions of the Promoter, which are final and binding.

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN THE JACKPOT. A PURCHASE OR MEMBERSHIP WILL NOT INCREASE YOUR CHANCES OF WINNING.

⚠️ ZERO TOLERANCE FOR HARM

Dead Certain Club does NOT support, condone, or encourage any form of foul play, harm, violence, or criminal activity towards any celebrity or public figure.

This is purely an entertainment platform based on natural life expectancy predictions. We categorically oppose any action that could cause harm to any individual.

AUTOMATIC DISQUALIFICATION: Any win will be deemed INVALID and void if the celebrity's death is determined to have occurred under suspicious circumstances, including but not limited to murder, manslaughter, or any form of foul play. In such cases, no prize will be awarded and the jackpot will roll over to the following month.

Any participant suspected of involvement in, knowledge of, or encouragement of harm to any public figure will be immediately and permanently banned, reported to law enforcement authorities, and forfeit all prizes and membership benefits.

1. Definitions

  • "Promoter" means Dead Certain Club
  • "Prediction Game" means the monthly entertainment game in which Participants select Public Figures they predict may pass away within the calendar month
  • "Member" means a person who has subscribed to a paid Membership Tier and maintains an active subscription
  • "Participant" means any eligible person who enters the Prediction Game, whether as a Member or via the Free Entry Route
  • "Pick" means a Participant's selection of a Public Figure for a given month
  • "Public Figure" means a celebrity, public personality, or notable individual included in the Promoter's curated selection pool
  • "Jackpot" means the prize pool allocated from a fixed percentage of Membership revenue, distributed to Winners
  • "Winner" means a Participant who correctly predicted a Verified Death and has satisfied all Winner Verification Requirements
  • "Verified Death" means the confirmed death of a Public Figure, verified by the Promoter according to the Verification Process
  • "Skill-Testing Question" means a mathematical question that potential Winners must correctly answer without assistance to claim a prize
  • "Free Entry Route" means the method by which eligible persons may enter the Prediction Game without payment or purchase

2. Eligibility

2.1 Age Requirement

Participation is open only to individuals who are eighteen (18) years of age or older at the time of entry. Proof of age may be required before prize fulfillment.

2.2 Geographic Eligibility

The Prediction Game is open to legal residents of the following jurisdictions ("Eligible Territories"):

  • Australia (all states and territories)
  • New Zealand
  • United Kingdom (England, Scotland, Wales, Northern Ireland)
  • Canada (all provinces and territories)
  • European Union member states: Germany, Spain, Austria, Belgium, Denmark, Finland, Sweden, Portugal, Luxembourg

EXCLUDED TERRITORIES

United States of America (all states and territories), Ireland, Italy, France, Netherlands, Poland, China, India, Middle East, Africa. Residents of excluded territories are not eligible to participate regardless of entry method.

2.3 Disqualified Persons

The following persons are not eligible to participate:

  • Directors, officers, employees, and contractors of the Promoter and its affiliates
  • Immediate family members (spouse, parent, child, sibling) and household members of the above
  • Any person involved in the development, production, or administration of the Prediction Game
  • Any person who has been excluded under responsible play provisions

3. How to Enter

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. Two entry methods are available, and both provide equal chances of winning.

3.1 Method A: Membership Entry (Paid)

Members with an active subscription may submit Picks through the Dead Certain Club platform. The number of monthly Picks varies by Membership Tier:

IMPORTANT: Membership fees provide access to the Dead Certain Club platform, community features, dashboards, alerts, and related entertainment services. Membership fees are NOT consideration for entry into the Prediction Game.

3.2 Method B: Free Entry Route (No Purchase Necessary)

To enter without purchase or payment, eligible persons may submit a Free Entry by mailing a handwritten entry to the address listed on our Free Entry page.

Free Entry Limits: One (1) Free Entry per calendar month. Free Entries must be postmarked by the 7th day of the applicable month and received by the 14th day.

4. Pick Rules and Restrictions

4.1 Pick Window

  • Picks open on the 1st day of each calendar month at 00:00:01 UTC
  • Picks close on the 7th day of each calendar month at 23:59:59 UTC
  • Picks cannot be changed, modified, or withdrawn after submission
  • Unused Picks do NOT roll over to subsequent months

4.2 Pick Pool

  • Picks must be selected from the Promoter's curated selection pool of Public Figures
  • The selection pool contains a minimum of 500 Public Figures at all times
  • Picks for persons not in the official selection pool are void

4.3 Pick Restrictions

  • A Participant may not pick the same Public Figure in two consecutive months
  • Each Participant may only submit Picks from one account or identity
  • Use of multiple accounts, false identities, or automated entry systems is prohibited and will result in disqualification

5. Jackpot and Prize Structure

5.1 Jackpot Funding

The Jackpot is funded by allocating a fixed percentage of total monthly Membership revenue (15-25%).

5.2 Prize Distribution

When a Verified Death occurs:

  • 90% of the accumulated Jackpot is distributed equally among all Winners who selected that Public Figure
  • 10% rolls over to the following month's Jackpot

5.3 Multiple Verified Deaths

If multiple Verified Deaths occur in the same month, each triggers a separate payout from the remaining Jackpot balance. Payouts are processed in chronological order of death verification.

5.4 No Verified Deaths

If no Verified Deaths occur in a calendar month, 100% of that month's Jackpot Allocation rolls over to the following month.

5.5 Rollover Limits

The maximum rollover period is six (6) consecutive months. If no Verified Death occurs within six months, the accumulated Jackpot will be distributed through a supplementary random draw.

5.6 Prize Values and Odds

Approximate Prize Value: Estimated individual prize values range from $50 to $100,000 or more, depending on Jackpot accumulation and number of Winners.

Odds of Winning: Odds depend on the total number of Picks submitted and the number of Participants who select each Public Figure.

6. Winner Determination and Verification

6.1 Winner Identification

A Participant is identified as a potential Winner if their Pick matches a Verified Death that occurred during the month for which the Pick was submitted. The Pick must have been submitted and recorded before the death occurred.

6.2 Skill-Testing Requirement (MANDATORY FOR ALL WINNERS)

IMPORTANT

Before any prize may be awarded, each potential Winner must correctly answer a mathematical skill-testing question without any assistance, within the time limit provided. This requirement applies to Winners in ALL jurisdictions.

The Skill-Testing Question will:

  • Be a four-part mathematical problem using addition, subtraction, multiplication, and division
  • Be administered electronically or by telephone
  • Require an answer within five (5) minutes
  • Not permit the use of calculators, computers, or other assistance

Example: (15 × 4) + (100 ÷ 5) − 18 = ?

6.3 Winner Verification Requirements

Before prize fulfillment, each potential Winner must provide:

  • Government-issued photo identification confirming identity and age
  • Proof of residence in an Eligible Territory
  • Completed and signed Winner Declaration and Release form
  • Completed tax documentation as required by applicable law
  • Bank account details for prize transfer

Verification Deadline: Winners must complete all verification requirements within fourteen (14) days of notification.

6.4 Prize Fulfillment

  • Prizes will be paid by electronic bank transfer
  • Prizes will be paid in the currency of the Winner's country of residence
  • Payment will be processed within thirty (30) days of completed verification

7. Taxes and Reporting

Winner Responsibility: Winners are solely responsible for all applicable taxes, duties, and fees associated with receiving and using a prize.

Withholding: Where required by law, the Promoter will withhold applicable taxes from prize payments.

Spain: Spanish residents acknowledge that gambling tax of up to 10% of prize value may apply.

8. Charity Allocation

A fixed percentage (5-10%) of monthly Membership revenue is allocated to the Charity Pool.

Members may vote on charity recipients from a curated list of registered non-profit organizations. Voting weight is based on membership tier.

The Charity Pool is donated to the winning charity at month end.

9. Entertainment Disclaimer

THIS IS AN ENTERTAINMENT SERVICE.

The Prediction Game is for entertainment purposes only and does not constitute gambling, betting, wagering, or investment.

  • Risk Scores: Risk scores displayed on the platform are for entertainment purposes only. They are not predictions, forecasts, or recommendations.
  • No Influence: Participants have no influence over the outcome of the Prediction Game. The Promoter does not cause, predict, or have advance knowledge of any death.
  • Prohibited Conduct: Participants must not take any action intended to harm, harass, threaten, stalk, or in any way affect the health, safety, or wellbeing of any Public Figure. Any such conduct will result in immediate and permanent disqualification, forfeiture of all prizes and benefits, and referral to law enforcement authorities.
  • Zero Tolerance: Dead Certain Club categorically opposes and does not support, condone, or encourage murder, violence, foul play, or any criminal activity. This platform is based solely on natural mortality predictions for entertainment purposes.

10. Death Verification Process

Verification Standard: A death is verified when confirmed by at least THREE (3) independent, reputable news sources including at least one major wire service (AP, Reuters, AFP) or national broadcaster (BBC, ABC, CBC).

Verification Timeline: The Promoter aims to verify deaths within twenty-four (24) hours of the first credible report.

Disputed Deaths: In cases of disputed, contested, or unclear deaths, the Promoter's determination is final.

Death Date: The official date of death is the date reported by verified sources. If two people die on the same day, the time based on AEDT will be taken into consideration.

SUSPICIOUS CIRCUMSTANCES - AUTOMATIC INVALIDATION

NO prizes will be awarded for any death that occurs under suspicious circumstances. This includes, but is not limited to:

  • Murder or homicide (confirmed or suspected)
  • Manslaughter
  • Assassination
  • Any form of foul play
  • Deaths under active criminal investigation
  • Deaths where the cause is undetermined pending investigation

In such cases, all picks for that Public Figure are voided and the jackpot allocation rolls over to the following month. The Promoter's determination of "suspicious circumstances" is final and not subject to appeal.

11. Privacy and Data Protection

The collection and use of personal information is governed by our Privacy Policy.

Data Collected: Name, date of birth, contact details, pick history, payment information (for Members), and verification documents (for Winners).

Winner Publication: By entering, you consent to publication of your first name, last initial, and region/country if you win a prize.

Data Rights: You have rights to access, correct, delete, and port your personal data. Contact privacy@deadcertainclub.com to exercise these rights.

12. Winner Publication

A list of Winners (first name, last initial, and region/country only) will be published on the Dead Certain Club website within thirty (30) days of prize fulfillment.

Australia: For prizes valued over AUD $250, winner details (initial, surname, postcode) will be published as required by South Australian regulations.

13. Responsible Play

The Promoter is committed to responsible entertainment. The following features are available:

  • Self-Exclusion: Exclude yourself for periods of 30, 60, 90 days, or permanently
  • Spending Limits: Set voluntary monthly spending limits
  • Activity History: Full transaction and activity history in your dashboard
  • Cooling-Off Period: New Members may cancel within 14 days for a full refund, less any prizes won
  • Support Resources: Links to gambling help services are provided on the platform

14. Limitation of Liability

Maximum Liability: The Promoter's total liability is limited to the greater of: (a) the Membership fees paid in the preceding twelve months; or (b) the value of any prize to which the Participant is entitled.

Excluded Losses: The Promoter is not liable for indirect, incidental, consequential, or punitive damages.

Technical Failures: The Promoter is not liable for technical malfunctions, network failures, or other issues affecting participation.

Consumer Law: Nothing in these Rules excludes rights under applicable consumer protection laws that cannot be excluded by contract.

15. Disputes and Governing Law

Promoter's Decision: All decisions of the Promoter regarding eligibility, entry validity, winner selection, and interpretation of these Rules are final and binding.

Dispute Resolution: Any dispute must first be submitted to support@deadcertainclub.com. The Promoter will respond within fourteen (14) days.

Governing Law: These Rules are governed by the laws of Victoria, Australia.

Local Laws: These Rules do not exclude the application of mandatory consumer protection laws of your country of residence.

16. General Conditions

  • Rule Changes: The Promoter reserves the right to modify these Rules at any time. Material changes will be communicated at least fourteen (14) days before taking effect.
  • Cancellation: The Promoter reserves the right to cancel, suspend, or modify the Prediction Game if fraud, technical issues, or other factors compromise its integrity.
  • Disqualification: The Promoter may disqualify any Participant who violates these Rules, acts fraudulently, or behaves in a manner that undermines the integrity of the Prediction Game.
  • No Assignment: Prizes are non-transferable and cannot be assigned, sold, or exchanged for cash (unless the prize is cash).
  • Entire Agreement: These Rules, together with the Privacy Policy and Terms of Service, constitute the entire agreement.

17. Regulatory Permits and Compliance

The Prediction Game is operated under the following permits and registrations:

  • Australia: South Australia Trade Promotion Lottery Licence
  • Canada (Quebec): Régie des alcools, des courses et des jeux Registration

Participants in other Eligible Territories may request copies of applicable local registrations by contacting compliance@deadcertainclub.com.

Australia

  • This promotion is conducted under SA Trade Promotion Lottery Licence
  • Prizes valued over AUD $250 require publication of winner details
  • The Promoter's liability is subject to the Australian Consumer Law

New Zealand

  • This promotion is conducted as a sales promotion scheme under the Gambling Act 2003
  • The Consumer Guarantees Act 1993 applies to New Zealand residents

United Kingdom

  • This promotion is structured as a Free Draw under Schedule 2 of the Gambling Act 2005
  • The Free Entry Route provides no less convenient method of entry than paid membership
  • The Promoter complies with the CAP Code for non-broadcast advertising

Canada

  • This contest is subject to federal and provincial laws including the Competition Act and Criminal Code
  • The Skill-Testing Question requirement applies to ALL Canadian winners without exception
  • Quebec residents: Contest registered with the Régie des alcools, des courses et des jeux
  • Consent to receive electronic communications complies with CASL

European Union

  • Data processing complies with the General Data Protection Regulation (EU) 2016/679
  • EU residents may exercise data subject rights under Articles 15-22 of the GDPR
  • Spain: Spanish gambling tax obligations apply to Spanish resident winners
  • Germany: The promotion complies with the German Act Against Unfair Competition (UWG)
  • EU consumers have a right to withdraw from distance contracts within 14 days
